Terms & Conditions (English)

Rental Period: 45 minutes. Your time starts when your receipt is provided to the operator. Overtime is billed automatically. No refunds for unused time, early return, weather, or refusal/termination for safety.

1. Life Jacket

SHRK provides and strongly recommends the use of a properly fitted life jacket at all times while using the equipment. If the Renter chooses not to wear the provided life jacket, the Renter acknowledges that this decision significantly increases the risk of serious injury or death and voluntarily assumes all risks associated with that decision.

2. Ocean & Weather Hazards

The Renter understands that the ocean presents changing conditions, including currents, waves, wind, boats, marine life, and other natural hazards. SHRK does not guarantee calm water or the absence of risk. The Renter agrees to remain within the designated area and follow all staff instructions at all times.

3. Assumption of Risk

I understand this activity involves inherent risks including falling, collision, drowning, injury, or death. I voluntarily assume all risks.

4. Release & Hold Harmless

I release and hold harmless SHRK Water Adventures, SHRK Rentals, all of its owners, officers, employees and agents, and Sipalitos (and its owners, operators and staff) (the “Released Parties”) from any and all claims, damages, injuries or liabilities arising from my use of the equipment or presence on the premises, including claims caused by the negligence of the Released Parties, to the fullest extent permitted by law.

5. Adult Responsibility

I am the adult responsible for this rental. I assume full responsibility for all children and any person I allow to ride during my rental time. Operators must be 16+. Younger children may only ride as passengers with an adult. All children must be supervised by an adult at all times.

6. Equipment, Damage & Late Return

I am responsible for the equipment. I authorize SHRK to charge my payment method for any damage, loss, late-return fees, overtime, or rescue/recovery costs related to this rental. I specifically acknowledge that I have read and agree to the Release of Liability and Hold Harmless provisions contained in this Agreement.

7. Personal Property

SHRK is not responsible for the loss, theft, or damage of any personal property, including phones, cameras, jewelry, wallets, keys, watches, clothing, or other personal belongings brought onto the premises or used during the rental.

8. Rescue & Recovery Costs

If SHRK or any third party must rescue me, recover equipment, or provide emergency assistance, I agree to pay all related costs.

9. Emergency Medical Authorization

In case of emergency, I authorize SHRK and medical personnel to provide or arrange medical treatment. I accept responsibility for any medical costs.

10. Right to Refuse / End Rental

SHRK may refuse or end the rental at any time for safety reasons (weather, behavior, equipment, capacity, or any safety concern) with no refund.

11. Rules

For rider comfort and hygiene, guests are encouraged to wear appropriate swimwear or a cover-up while using the water bike. SHRK disinfects all contact surfaces between each rental. No alcohol or drugs. Stay in the designated area. Follow all staff instructions.

No Warranties. The Renter acknowledges that the equipment is rented “AS IS” and “WITH ALL FAULTS.” SHRK Water Adventures, SHRK Rentals, Sipalitos, and their respective owners, officers, employees, agents, contractors, and representatives make no express or implied warranties regarding the equipment, including, but not limited to, any warranty of merchantability, fitness for a particular purpose, or uninterrupted performance. The Renter acknowledges that the equipment has been visually inspected prior to use and accepts it in its current condition. The Renter agrees to immediately notify SHRK of any defect, damage, malfunction, or unsafe condition before or during use and will discontinue use of the equipment if it appears unsafe.

12. Governing Law & Language

This Agreement shall be governed by the laws of the State of Quintana Roo and the applicable federal laws of the United Mexican States. I confirm I have read and understand this agreement in the language provided. If both English and Spanish versions are present, both are binding.

Términos y Condiciones (Español)

Período de renta: 45 minutos. Su tiempo comienza cuando su recibo es entregado al operador. El tiempo extra se cobra automáticamente. No hay reembolsos por tiempo no utilizado, devolución anticipada, clima, o rechazo/terminación por seguridad.

1. Chaleco Salvavidas

SHRK proporciona y recomienda enfáticamente el uso de un chaleco salvavidas debidamente ajustado en todo momento mientras se usa el equipo. Si el Arrendatario decide no usar el chaleco salvavidas proporcionado, reconoce que esta decisión aumenta significativamente el riesgo de lesiones graves o muerte y asume voluntariamente todos los riesgos asociados con esa decisión.

2. Peligros del Mar y Clima

El Arrendatario entiende que el mar presenta condiciones cambiantes, incluyendo corrientes, oleaje, viento, embarcaciones, vida marina y otros peligros naturales. SHRK no garantiza condiciones de agua tranquilas ni la ausencia de riesgos. El Arrendatario acepta permanecer dentro del área designada y seguir todas las instrucciones del personal en todo momento.

3. Asumción de Riesgo

Entiendo que esta actividad implica riesgos inherentes incluyendo caídas, colisiones, ahogamiento, lesiones o muerte. Asumo voluntariamente todos los riesgos.

4. Liberación y Exención de Responsabilidad

Libero y exonero de responsabilidad a SHRK Water Adventures, SHRK Rentals, todos sus propietarios, oficiales, empleados y agentes, y a Sipalitos (y sus propietarios, operadores y personal) (las “Partes Liberadas”) de cualquier reclamación, daño, lesión o responsabilidad que surja de mi uso del equipo o presencia en las instalaciones, incluyendo reclamaciones por negligencia de las Partes Liberadas, en la máxima medida permitida por la ley.

5. Responsabilidad del Adulto

Soy el adulto responsable de esta renta. Asumo total responsabilidad por todos los niños y cualquier persona que permita montar durante mi tiempo de renta. Los operadores deben tener 16 años o más. Los niños menores solo pueden ir como pasajeros con un adulto. Todos los niños deben estar supervisados por un adulto en todo momento.

6. Equipo, Daños y Devolución Tardía

Soy responsable del equipo. Autorizo a SHRK a cargar a mi método de pago cualquier cargo por daños, pérdida, devolución tardía, tiempo adicional o costos de rescate/recuperación relacionados con esta renta. Reconozco expresamente que he leído y acepto las disposiciones de Exención de Responsabilidad y Liberación de Responsabilidad contenidas en este Acuerdo.

7. Propiedad Personal

SHRK no es responsable por la pérdida, robo o daño de cualquier propiedad personal, incluyendo teléfonos, cámaras, joyas, carteras, llaves, relojes, ropa u otros objetos personales traídos a las instalaciones o usados durante la renta.

8. Costos de Rescate y Recuperación

Si SHRK o un tercero debe rescatarme, recuperar equipo o brindar asistencia de emergencia, acepto pagar todos los costos relacionados.

9. Autorización Médica de Emergencia

En caso de emergencia, autorizo a SHRK y al personal médico a proporcionar o gestionar tratamiento médico. Acepto responsabilidad por cualquier costo médico.

10. Derecho a Rechazar / Terminar la Renta

SHRK puede rechazar o terminar la renta en cualquier momento por razones de seguridad (clima, comportamiento, equipo, capacidad o cualquier preocupación de seguridad) sin reembolso.

11. Reglas

Para la comodidad e higiene del jinete, se recomienda a los huéspedes usar ropa de baño apropiada o una cubierta mientras usan la bicicleta acuática. SHRK desinfecta todas las superficies de contacto entre cada renta. No se permite alcohol ni drogas. Permanezca en el área designada. Siga todas las instrucciones del personal.

Sin Garantías. El Arrendatario reconoce que el equipo se renta “TAL CUAL” y “CON TODOS LOS DEFECTOS.” SHRK Water Adventures, SHRK Rentals, Sipalitos y sus respectivos propietarios, oficiales, empleados, agentes, contratistas y representantes no ofrecen garantías expresas o implícitas respecto al equipo, incluyendo, entre otras, cualquier garantía de comerciabilidad, idoneidad para un propósito particular o rendimiento ininterrumpido. El Arrendatario reconoce que el equipo ha sido inspeccionado visualmente antes de su uso y lo acepta en su condición actual. El Arrendatario acepta notificar inmediatamente a SHRK de cualquier defecto, daño, mal funcionamiento o condición insegura antes o durante el uso y discontinuará el uso del equipo si parece inseguro.

12. Ley Aplicable e Idioma

Este Acuerdo se regirá por las leyes del Estado de Quintana Roo y las leyes federales aplicables de los Estados Unidos Mexicanos. Confirmo que he leído y entiendo este acuerdo en el idioma proporcionado. Si están presentes tanto la versión en inglés como en español, ambas son vinculantes.
