1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the SHRK Rentals & Sales website and the rental and sales services we provide. By accessing our website, submitting a booking request, or participating in any SHRK experience, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

These Terms constitute a legally binding agreement between you ("you," "Participant," or "Customer") and SHRK Rentals & Sales ("SHRK," "we," "us," or "our").

2. Description of Services

SHRK provides water bike rental experiences and water bike sales across our operating locations. Our rentals involve pedal-powered, motorless water bikes used for recreation, fitness, and exploration on open water. Our sales involve the purchase of Red Shark water bikes and related modular accessories.

Rental experiences are booked as pending requests. Submission of a booking request does not guarantee availability. A SHRK team member will confirm your reservation and collect any required deposit or payment before the experience is finalized.

3. Bookings and Reservations

All bookings are submitted as requests and are subject to availability and weather conditions.
SHRK reserves the right to decline, reschedule, or cancel any booking for safety, weather, or operational reasons.
You must provide accurate and complete information when booking, including valid identification.
All participants must sign our digital rental agreement and liability release before departure.
A valid government-issued ID must be uploaded and verified prior to participation.
Participants must be at least 18 years old to sign the rental agreement. Minors may participate only with a parent or legal guardian who has signed the agreement on their behalf.

4. Payment and Cancellation

Pricing: Pricing for rentals and sales is determined on a case-by-case basis and confirmed by SHRK before payment. Seasonal surcharges may apply during holidays and peak periods.

Deposits: A deposit may be required to secure your reservation. The deposit amount and balance terms will be communicated at the time of booking confirmation.

Cancellation by Customer: Cancellation policies, including any refund eligibility, will be communicated at the time of booking. Cancellations due to weather or safety concerns determined by SHRK will be eligible for rescheduling or refund at our discretion.

Cancellation by SHRK: SHRK reserves the right to cancel or reschedule any experience due to weather, safety concerns, equipment issues, or circumstances beyond our control. In such cases, customers will be offered a rescheduled date or a refund of amounts paid.

5. Rental Terms and Conditions

Equipment remains the property of SHRK at all times during a rental.
Participants must follow all safety instructions provided by SHRK staff before and during the experience.
Participants are responsible for any damage to equipment caused by negligence, misuse, or failure to follow instructions.
Equipment must be returned in the condition it was provided, normal wear and tear excepted.
SHRK is not responsible for personal belongings lost or damaged during the experience.
Participants must be physically capable of operating a water bike and must disclose any medical conditions that may affect their ability to participate safely.
Life jackets or personal flotation devices must be worn as directed by SHRK staff.

6. Assumption of Risk and Liability Release

Water biking and related water activities involve inherent risks, including but not limited to: drowning, injury from equipment, collision with objects or other watercraft, exposure to weather and marine life, and fatigue. By participating in any SHRK experience, you voluntarily assume all risks associated with the activity, whether known or unknown.

To the fullest extent permitted by law, you agree to release, waive, and discharge SHRK, its owners, employees, partners, and agents from any and all claims, damages, losses, or injuries arising out of or related to your participation, including those caused by the ordinary negligence of SHRK. This release does not cover claims of gross negligence or willful misconduct.

7. Sales Terms

For purchases of Red Shark water bikes and accessories:

All sales are processed as inquiries first. Pricing, availability, and delivery terms are confirmed by SHRK before payment.
Products are warranted by the manufacturer (Red Shark) according to the manufacturer's warranty terms. SHRK facilitates but does not independently warrant manufacturer products.
Customs, import duties, and taxes for international shipments are the responsibility of the buyer.
Returns and exchanges are subject to the manufacturer's return policy and applicable law.

8. User Conduct

You agree not to:

Use our website or services for any unlawful purpose.
Provide false, inaccurate, or misleading information.
Attempt to access, alter, or damage our systems, data, or another user's information.
Use our content or brand without authorization.
Engage in behavior that endangers yourself, other participants, SHRK staff, or the public.

9. Intellectual Property

All content on this website, including the SHRK name, logo, text, images, design, and software, is owned by SHRK or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or use any content without prior written permission, except to view pages in your browser for personal, non-commercial use.

10. Disclaimers

Our website and services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. SHRK does not warrant that our website will be uninterrupted, error-free, or secure, or that any experience will meet your expectations.

Weather, water, and ocean conditions are variable and beyond our control. SHRK is not liable for experiences affected by natural conditions, acts of God, or circumstances beyond our reasonable control.

11. Limitation of Liability

To the fullest extent permitted by law, SHRK shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of our website or services, including but not limited to loss of profits, data, or goodwill. Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid to SHRK for the specific booking or purchase giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless SHRK, its owners, employees, partners, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of our services, your violation of these Terms, or your violation of any rights of another party.

13. Governing Law

These Terms are governed by the laws of the United Mexican States, with primary jurisdiction in Quintana Roo, Mexico. Any disputes arising from these Terms or your use of our services shall be resolved in the courts of Tulum, Quintana Roo, Mexico, unless otherwise required by mandatory consumer protection laws in your jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Your continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
